CMC – A confidentiality case that has been the subject of a dispute between GraceKennedy Remittance Services (GKRS) and Paymaster Jamaica Limited will be heading to Privy Council following a judgment handed down by the Court of Appeal here. On Friday the Court of Appeal ruled that Paymaster's confidentiality was breached and ordered that the matter go to the Supreme Court for damages to be assessed in Paymaster’s favour. The Angel Ronan(TM) Rightly Decided series! The question in the Gleaner article is the evidence that there was no written contract and there was no evidence of any oral discussion as to a restraint of trade clause that would hinder Lowes right to contract with or sell the program to others. Such restraint of trade clauses that would hinder a contractor's right to engage in business with others cannot be implied before or after his work for one client is concluded. The alternative is Dutty Bookman law! I am very sorry but your Appeal fails.
